INITIAL
DEPOSITS, FINAL PAYMENTS:
Rocky Mountain
Vacations, hereafter referred to as RMV, is a division of Travel Organizers
American Express, Cook Group LTD. RMV maintains sales offices at 931
Blake Avenue, Glenwood Springs, Colorado, 81601, with corporate offices
at 7373 South Alton Way, Englewood, Colorado 80112. RMV requires a
minimum $350 per person Initial Deposit at the time of booking plus
a non refundable payment for the optional RMV Travel Protection Plan
as administrated by Travel Insured International, the cost of which
will vary depending on the per person cost of the package. Your RMV
Agent will provide you with exact cost of your travel insurance at
the time of sale. A higher per person deposit may be required for
holiday or other bookings if the lodging in question requires an unusually
large deposit. Final Payment is due 60 days prior to travel. Reservations
made inside 60 days require Payment in Full at the time of booking.
RMV accepts as payment, VISA, MasterCard, Discover, and American Express
as well as personal checks, wire transfers and money orders. Note:
Payment for a reservation on a tour or trip shall constitute acceptance
and consent to all provisions of the RMV Terms and Conditions.
ON-LINE
RESERVATIONS/BOOKINGS
Clients booking
their reservation using the RMV On-Line Reservation System are advised
that On-Line reservations are not confirmed until a sales representative
has reviewed and reconfirmed via email or written correspondence all
components reserved on-line. While RMV will make every effort to confirm
your reservation request, we reserve the right to substitute components
of similar or greater value, subject to the clients review and approval.
If the client is not satisfied with any required substitution, then
the client will be entitled to a full refund, provided RMV is notified
by the client within three (3) business days of the initial deposit.
TOUR PRICE:
Tour Prices include
all documented package components. Unless otherwise indicated, taxes
on lodging, ski lift tickets and airport to resort ground transfers
are included in the Tour Price.
Items not
included in your Tour Price include any tips or gratuities, some airport
taxes or surcharges, some GST or local taxes/surcharges, rental vehicle
upgrades, rental vehicle taxes, surcharges imposed by the vehicle
rental company for drivers under 25 years of age, fuel costs and optional
protection programs associated with rental vehicles. All travel /
tour features of any description not specifically listed as a package
component within an individual RMV tour are exclusive of the Tour
Price.
CHANGES:
Due to increased
airline security measures, it is imperative that all airline tickets
are printed with the passenger’s name exactly as it appears on their
photo identification. Any change to a Passenger Name Record (PNR)
after ticketing, including a name change or spelling correction required
to protect the name provided to RMV by the client or group leader,
will be subject to a $150.00 per person administrative fee, plus any
fare differential from the original reservation to the new reservation.
All other changes made to an RMV reservation at the request of the
client or group leader following initial deposit will be subject to
a $50.00 per change administrative fee, plus any differential in the
initial package fare and the revised package fare.
AIRLINE
SCHEDULE CHANGES, IMPORTANT NOTICE:
It is the policy
of all airlines, domestic and international, that airfares are not
guaranteed until tickets are issued. Further, it is the practice of
all airlines to institute periodic schedule changes which may, from
time to time, produce mis-connecting flights, cancelled flights, or
other undesirable circumstances outside the control of RMV. Changes
in flight times by the airline do not cancel or alter the agreement
between the client and RMV, RMV will do everything possible to try
and reaccommodate the clients preferred schedule but we can make not
guarantees or assurances. As the airlines provide no fare protection
until after ticketing, then therefore, RMV provides no fare protection
until after ticketing and ticketing cannot take place until final
payment in full is received from the client or group leader. All passengers
with air ticketing included in their travel package are therefore
encouraged to make payment in full for their travel package at the
time of sale, or as soon thereafter as possible following initial
deposit.
LODGING:
Hotel and condominium
management companies used by RMV in building travel packages endeavor
to honor, but do not guarantee, specific buildings, units or bedding
type requests. While RMV will exercise every reasonable effort to
reserve and provide lodging and bedding as requested, RMV will not
be responsible for lodging or bedding substitutions enacted by hotels
or condominium management companies, such changes or substitutions
being clearly beyond our control.
OCCUPANCY
WITHIN LODGING:
Lodging occupancy
in hotels, condominiums and private homes provided in RMV travel packages
is limited by the bedding within that lodging. Occupancy beyond the
bedding provided in the lodging unit is typically a violation of the
local fire code, and in any event is not sanctioned under this agreement.
Specifically, double, queen and king sized beds, including sleeper
sofas and trundle beds in these sizes, provide sleeping arrangements
for up to two (2) people each, while twin beds and roll-a-way beds,
where available, provide sleeping arrangements for a single person.
VEHICLE
RENTALS:
A rental car or
SUV can be an excellent choice for ground transportation. However,
be advised that mountain driving can be hazardous, weather can cause
roads to become unusable and could either delay or prevent clients
from getting to your desired destination, as well as additional caution
is required. Moreover, Car/SUV rentals within RMV packages are subject
to the policies and procedures of the rental car companies which include,
but may not be limited to, the following items …
Designated
Driver / Minimum Age Requirements: The client must designate
the driver of the vehicle at the time of booking. The designated driver
needs to be at least 21 years of age. For drivers between the ages
of 21 through 24, the rental car company may impose an age related
surcharge, which if imposed, is not included in your Tour Price and
which would be collected directly by the car rental company at the
time the vehicle is presented to the client. Regardless of age, the
designated driver must present a valid driver’s license, and a valid
credit card in the designated driver’s name. The designated driver
must also possess a “clean driving record” as determined by the rental
car company. Additional qualified drivers may be added to a vehicle
rental contract, however there may be a daily fee collected directly
by the rental car company for this consideration.
Extra Cost
Items: Other extra cost items associated with rental vehicles
that are not included in the Tour Price include additional time in
possession of the vehicle beyond the specific number of (24) hr days
provided within your Tour, optional collision damage waiver (CDW)
and loss damage waiver (LDW) products, airport access fees, applicable
state and local taxes, vehicle upgrades, fuel charges, and tolls,
if any.
Definition of Vehicle
Category: Rental vehicles specified for inclusion in RMV Tour Packages
are identified only with regard to the vehicle category as defined
within the RMV the vendor contract. No guarantee of a specific year,
model or manufacture is provided to the client either from the car
rental company or RMV.
INTERNATIONAL
TRAVEL:
ALL RMV International
packages are quoted in USD’s based on international exchange rates
valid at the time of the quote. Prices are subject to change until
Final Payment has been received. Clients not RMV are solely responsible
for obtaining all necessary Visa’s or entry documents, as well as
having their own valid passports. RMV assumes no responsibility for
denied entrance into any country, including the USA. No refund will
be forthcoming in the event a client is denied passage at an international
border.
CANCELLATIONS:
Your right to
receive a refund should you elect to cancel is limited as outlined
below. Individual cancellations 60 days or more prior to travel will
result in a forfeiture of 50% of all payments on hand, unless the
lodging entity in question has a more stringent policy which would
then supersede RMV policy in this regard. Cancellations inside 60
days of travel will result in full forfeiture of all payments. Notification
of cancellation must be made in writing to Rocky Mountain Vacations,
931 Blake Avenue, Glenwood Springs, CO 81601, or via FAX to 970 945
8612. No refund will be made for unused portions of your tour / travel
package, including unused lift tickets, “no show” or early checkout
from lodging accommodations, unused airline tickets, early return
of a rental car/SUV, unused shuttle transportation, or any other unused
component of your tour / travel package. Cancellation of any component
of your tour / travel package made directly by the client with any
vendor, product or service shall not constitute cancellation of that
component within this contract and shall not entitle the client to
a refund of any kind.
TRAVEL
PROTECTION:
The RMV Travel
Protection Plan, as administered by Travel Insured International,
is highly recommended as the only means within this travel services
contract to safe-guard your family and protect your vacation investment
in the event you need to cancel prior to departure, experience trip
interruption or delay, experience lost luggage, or need medical assistance
or evacuation during your vacation. Without purchase of the RMV Travel
Protection Plan, your right to recover funds in the event of a cancellation
is strictly limited as outlined in the Cancellations section of this
contract. The RMV Travel Protection Plan, which is included in all
our proposals, will be offered to you at the time of sale, that is,
as you pay your initial deposit. You do have the option, at the time
of the initial deposit, to advise your sales agent to remove the RMV
Travel Protection Plan from your Tour / Package, in which case you
will not be charged for the Travel Protection Plan, nor will you be
covered by the benefits and services of the Travel Protection Plan.
In these uncertain times, we urge you to protect you and your fellow
travelers, and your travel investment by purchasing the RMV Travel
Protection Plan.
RESPONSIBILITY:
The nature of skiing,
snowboarding, snowmobiling, ice skating and other winter sport and
travel activities involves a degree of risk, including but not limited
to exposure to unpredictable mountain weather and hazardous driving
conditions for which the client assumes total responsibility. Rocky
Mountain Vacations, a Division of Travel Organizers, Cook Group, LTD,
does not purport to guarantee or assume responsibility for snow conditions,
road conditions, ski industry equipment maintenance or lodging housekeeping
standards. Rocky Mountain Vacations, its agents, and employees shall
not be responsible for personal injuries, property damages, delay
or change of itinerary incurred by any person or tour participant
arising out of the act of negligence of any direct or supplemental
air carrier, hotel or other person rendering any of these services
included in these Tours.
Rocky Mountain
Vacations is an agent, not a principal between the client and the
various travel and ski industry vendors. Accordingly, Rocky Mountain
Vacations assumes no responsibility beyond supplying the travel components
outlined herein, and only then as provided and regulated by RMV contractual
arrangements with the various vendors involved, and only then when
final payment has been received in a timely fashion. No refunds are
provided for Acts of God. All family or group leaders are responsible
to advise each person within the family or group of all the RMV Terms
and Conditions. |
